Is Microdosing Legal? Truffles and the Law in the Netherlands
By Microdosing College Editorial·Last updated May 4, 2026·8 min read
"Is microdosing legal?" has no single answer — it depends entirely on the substance and the country. In the Netherlands, psilocybin mushrooms have been banned since 2008, yet psilocybin truffles (sclerotia) were never added to that ban and remain legal to buy and sell domestically. Almost everywhere else, any psilocybin is a controlled drug.
This guide explains the precise legal line the Dutch drew between mushrooms and truffles, why it exists, and the limits you need to understand before assuming anything is permitted where you live. It is educational and is not legal advice — laws change, and only a qualified local source can tell you what applies to you. For the wider picture, see our pillar guide to microdosing psilocybin.
Why is microdosing's legality so different from country to country?
The legality of microdosing turns on one thing: psilocybin's legal status where you are. Psilocybin is a Schedule I / List I controlled substance in most of the world, including the United States, the United Kingdom, and most of the EU. That means possessing the substance — at any dose, microdose or not — is generally an offence regardless of intent.
Microdosing itself is not a legal category. No law distinguishes a 0.1 g "microdose" from a larger amount; what matters is whether the molecule you possess is scheduled. So the honest answer to "is microdosing legal?" is almost always: only if the specific material you hold is not a controlled substance in your jurisdiction. A handful of places — the Netherlands (truffles), parts of the US such as Oregon and Colorado (regulated therapeutic frameworks), and a few decriminalised cities — are exceptions, each with narrow, specific rules.
Because the rules are this fragmented, the rest of this guide focuses on the one widely-cited example people actually ask about: the Netherlands, and its unusual mushroom-versus-truffle split.
What exactly did the Netherlands ban in 2008?
On 1 December 2008, the Netherlands amended its Opium Act to place psilocybin- and psilocin-containing mushrooms on List II (the "soft drugs" list). The amendment named roughly 188 fungal species — covering both fresh and dried mushrooms — making it illegal to import, export, cultivate, sell, possess, or transport them.
Before that date, fresh magic mushrooms had been sold openly in Dutch "smart shops." The ban followed political pressure after high-profile incidents involving tourists, and it specifically targeted the mushroom — the above-ground fruiting body of the fungus. The relevant legal control is documented in reference summaries such as Wikipedia's "Magic truffle" entry, which traces the legislative history and the wording of the prohibition.
The word "mushrooms" in the legislation did real work. Because the ban enumerated mushroom species and the mushroom form, anything that contained the same active compounds but was not a mushroom in the botanical sense fell outside the listed prohibition. That gap is where truffles sit.
Why are psilocybin truffles still legal in the Netherlands?
Truffles are legal in the Netherlands because they are sclerotia, not mushrooms — and only mushrooms were added to the 2008 ban. A sclerotium is a dense, underground mass of compacted fungal tissue (mycelium) that certain Psilocybe species form when conditions do not favour growing an above-ground mushroom. It contains psilocybin and psilocin, but it is a different growth form.
Dutch authorities had a basis for treating them separately. A risk assessment by the Coordination Centre for the Assessment and Monitoring of New Drugs (CAM), attached to the national public-health institute (RIVM), concluded the health risks of truffles were low, and the 2008 amendment was written around mushrooms specifically. Because sclerotia were not listed, they were not prohibited. The distinction is summarised in legal explainers and the European Union Drugs Agency (EMCDDA/EUDA) country reporting on Dutch drug law.

A crucial nuance: only fresh truffles enjoy this status. Drying, extracting, or processing truffles can change their legal footing, because processing concentrates the listed substance psilocybin — at which point you may be handling a controlled preparation rather than a legal natural product. This is one reason most people who microdose truffles in the Netherlands measure fresh material rather than home-made extracts. If you want the practical mechanics of dosing, see how to microdose psilocybin and our guide to microdosing dosage.
Does "legal" mean "safe" or "risk-free"?
No. Legality is a statement about the law, not about your health. A substance being legal to sell says nothing about whether it is appropriate for you, and the evidence that microdosing delivers reliable benefits is genuinely mixed. The largest placebo-controlled study to date — Szigeti and colleagues' self-blinding citizen-science trial of around 191 people, published in eLife (2021) — found that much of the perceived benefit was explained by the placebo effect, a conclusion echoed in Imperial College London's summary of the work.
Legal access also does not remove medical risk. Psilocybin can interact dangerously with some medications and is contraindicated in several situations — for example, lithium is associated with seizure risk when combined with psychedelics, per the Psychiatric Times clinician's guide to psilocybin interactions. A personal or family history of psychosis is another important caution. Before considering anything, read our honest accounts of microdosing side effects and the contraindications and drug interactions that should rule it out entirely for some people. What if I'm not in the Netherlands — can I order or carry truffles?
Generally no. Dutch smart shops and reputable vendors ship truffles within the Netherlands only, and for good reason: the moment truffles cross a border, they enter a jurisdiction where psilocybin is almost certainly a controlled substance. Importing them — by post or in your luggage — can constitute drug importation even though buying them in Amsterdam was lawful.
A few practical realities follow from this:
The Dutch exemption is territorial. It legalises domestic sale and possession of fresh truffles inside the Netherlands; it grants you nothing once you leave.
Mail-order across borders is not a loophole. Customs and the destination country's drug laws apply to the parcel, not Dutch law.
"Legal in Amsterdam" travel content can mislead. Some people travel to the Netherlands specifically because truffles are legal there; this is also why a regulated, supervised setting such as a legal retreat exists as an option some choose over self-experimentation.
If you live elsewhere and want to understand the actual research before any decision, our evidence review — does microdosing work? — and the research library summarise what the studies do and do not show, without the hype.
The bottom line
Microdosing has no special legal status anywhere; its legality rides entirely on whether the substance is controlled where you are. In the Netherlands, a precise quirk of the 2008 Opium Act — it banned mushrooms but not sclerotia — keeps fresh truffles legal to buy and sell domestically. That exemption does not cross borders, does not cover processed products, and does not imply the practice is safe or effective for you. Treat this as a starting point for your own research and, where it matters, a conversation with a qualified local professional — not as legal advice.
Frequently asked
Are psilocybin truffles legal in the Netherlands?+
Yes — fresh psilocybin truffles (sclerotia) are legal to buy and sell within the Netherlands. The 2008 Opium Act amendment banned around 188 psilocybin mushroom species but did not list truffles, which are a different, underground growth form. Only fresh, unprocessed truffles are covered; drying or extracting them can change their legal status.
Why are truffles legal when magic mushrooms are banned?+
Because the 2008 Dutch ban named mushrooms — the above-ground fruiting body — while truffles are sclerotia, a compacted mass of underground fungal tissue. Both contain psilocybin, but only mushrooms were placed on the Opium Act list, so truffles fall outside the prohibition.
Can I order Dutch truffles to another country?+
No. Reputable vendors ship truffles within the Netherlands only. Psilocybin is a controlled substance in most other countries, so importing truffles by post or in luggage can be a drug offence even though buying them in the Netherlands was legal. The Dutch exemption is territorial.
Does legal mean microdosing is safe?+
No. Legality concerns the law, not your health. The largest placebo-controlled study found much of microdosing's benefit was a placebo effect, and psilocybin can interact dangerously with medications such as lithium. Legal access does not remove medical risk or guarantee benefit.
This guide is general educational information about microdosing, not medical advice and not a recommendation to use any substance. It can't account for your personal health. If you take medication or live with a mental-health condition, speak with a qualified professional before making any decision.
