If the legal map looks chaotic, it helps to start at the root. A surprising amount of the world's psilocybin law traces back to a single document.
In 1971, the UN Convention on Psychotropic Substances placed psilocybin and psilocin — the two active compounds — in Schedule I, its most restrictive category, reserved for substances judged to have high abuse potential and no accepted medical use at the time. Most countries are signatories, and most wrote that scheduling into their own national law. That is the historical backbone of why prohibition is the global default. When you find a country that bans these compounds, you are usually looking at the long shadow of 1971.
But a treaty written about chemicals left a gap that nature did not respect.
The 1971 treaty scheduled the molecule. It did not always schedule the mushroom that contains it.
Here is the distinction that explains most of the world's odd exceptions. The Convention scheduled the substance — the molecule psilocybin. It did not automatically schedule every organism that happens to produce it.
That opens a genuine ambiguity. A mushroom or a truffle is not itself "psilocybin"; it is a living thing that contains psilocybin. So a country has a choice in how it writes its own law:
It can ban only the named chemical, leaving the organism in a grey zone.
It can explicitly add the mushroom, or the spores, or the fresh and dried forms, closing the gap.
It can name some forms and quietly miss others.
The Dutch truffle lives precisely in this gap, which the next lesson covers in detail. The same active compound can be unlawful in one physical form and lawful in another, simply because of how the legislation was worded. The grey zone is not a clever loophole someone found — it is the seam where chemistry and legal drafting fail to line up perfectly.
The second reason the map is a patchwork is that law is built in layers, and the layers do not always agree.
International treaty — the 1971 Convention sets a baseline expectation for signatory countries.

Regional and city policy — within a country, a state, province, or city can set its own enforcement priorities or local rules.
Because each layer is written by different people with different aims, they can contradict one another. This is how you end up with a city that has decriminalised personal possession while the country around it still firmly prohibits — the local layer and the national layer simply disagree. A traveller who reads only the national headline, or only the city's reputation, will get the picture wrong.
None of these layers is fixed, and three forces in particular keep redrawing them.
Enforcement priorities. A law can stay on the books while police and prosecutors quietly deprioritise it — or sharpen their focus on it after an incident.
Medical-research carve-outs. As clinical studies expand, some jurisdictions create narrow, tightly controlled exceptions for supervised or research use, distinct from anything recreational.
Shifting public opinion. Decriminalisation and reform tend to follow changes in how the public sees these substances, which is why the map looks so different from a decade ago.
Put together, this is why two neighbouring countries — or even two cities in one country — can land in completely different places. The status is not the product of a single clean logic. It is the residue of history, treaty obligations, drafting choices, enforcement decisions, and public mood, all layered on top of one another.
A last word on why this matters here. This is a description of how the patchwork forms, not a guide to its loopholes. Understanding why borders differ is preparation, not permission. It sets up the next lesson on the Netherlands, and it builds the habit this whole course depends on: never assume that one country's rule travels with you across a line on the map.
